Big man has yet to KILL or HARM anyone
Big man is committing act of terror and is a threat

Big man has a gun
Big man is in central park square, firing an AK47
Big man hasn't KILLED or HARMED anyone yet
Big man is still committing mass shooting, is a threat and committing an act of terror

Besides, the shootings were by civilains being CHASED AROUND THE PLACE BY THE CLOWN WITH A MACHETE
Would you shoot a creepy guy in a demented forest trying to lure your children to a forest, especially once he has a machete?

Acts of terror is still very much a law break.

Normally, I disagree massively with the American civilian rights to posses a gun
However, cases like this, I'm completely fine with it.
If you're going to try to kidnap children and chase after people whilst swinging MACHETES, you deserve to get shot.
