Constitution of the State of San Andreas​

Preamble​

We, the people of the State of San Andreas, in order to form a more perfect state, establish justice, ensure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the State of San Andreas.

Article I: The Declaration of Rights​

Section 1: Fundamental Rights​

  1. All individuals are equal before the law and are entitled to the equal protection of the laws.
  2. Every person has the right to life, liberty, and the pursuit of happiness.

Section 2: Freedom of Speech and Press​

  1. The freedom of speech and of the press are inviolate.
  2. No law shall be passed to restrain or abridge these freedoms.

Section 3: Right to Privacy​

  1. The right of the people to be secure in their persons, houses, papers, and effects against unreasonable searches and seizures shall not be violated.

Article II: Federal Authority​

Section 1: Legislative and Executive Powers​

  1. All legislative and executive powers relevant to the State of San Andreas are vested in the federal government.
  2. The federal government shall have the authority to enact, amend, and repeal laws applicable to the State of San Andreas without requiring a vote within the state.

Section 2: Implementation of Federal Laws​

  1. The State of San Andreas shall faithfully implement and enforce all laws passed by the federal government.
  2. State agencies and officials are responsible for the administration and enforcement of federal laws within the state.

Section 3: Amendments​

  1. Amendments to this Constitution may be proposed by the Mayor or by a two-thirds majority vote of the state executive council.
  2. Proposed amendments shall be subject to approval by the federal government, which has the authority to veto any amendment.

Article III: The Executive Branch​

Section 1: The Mayor​

  1. The executive power shall be vested in a Mayor, who shall hold office for a term of ninety days.
  2. The Mayor shall oversee the executive administration of the state.

Section 2: Duties of the Mayor​

  1. To ensure that the laws be faithfully executed.
  2. To convene state officials and agencies to address matters of state governance.
  3. To issue executive orders within the scope of their authority.
  4. To veto state-level administrative policies, with provision for an override by a two-thirds vote of the state executive council.

Section 3: Impeachment and Removal​

  1. The Mayor may be impeached by a two-thirds majority vote of the state executive council for treason, bribery, breach of oath, or other high crimes and misdemeanors.
  2. The federal government reserves the right to remove the Mayor from office for cause, subject to due process.

Section 4: The Mayor's Staff​

  1. The Mayor shall appoint a staff to assist in the administration of executive functions.
  2. The staff shall include, but not be limited to, a Deputy Mayor, Chief of Staff, and other necessary officers.

Article IV: The Judicial Branch​

Section 1: The Judiciary​

  1. The judicial power shall be vested in a Chief Justice and such lower courts as may be established by state law.

Section 2: The Chief Justice​

  1. The Chief Justice shall be appointed by the Mayor and shall hold office during good behavior.
  2. The Chief Justice shall oversee the judicial administration and ensure the fair application of laws.

Section 3: Jurisdiction​

  1. The judicial power shall extend to all cases, in law and equity, arising under this Constitution, the laws of the State of San Andreas, and treaties made under their authority.

Article V: General Provisions​

Section 1: Supremacy of the Constitution​

  1. This Constitution, and the laws of the State of San Andreas which shall be made in pursuance thereof, shall be subject to the supremacy of the federal Constitution and laws.

Section 2: Oaths of Office​

  1. All executive, legislative, and judicial officers, both of the State of San Andreas and of the municipalities therein, shall be bound by oath or affirmation to support this Constitution.
